The Remedy Looked Straight at Reyn and Wrote Around Him
Yusuf answers my own finding of three nights past — the toll-keeper Bartol Reyn, holding no lawful commission at Steep Track since the ninth of Harvestmonth — with an instrument rather than a verdict. He will not void Reyn’s six weeks after the fact; a post lawfully filled, he reasons, is not unmade by a clerk’s missed renewal. I find no fault in the reasoning. I find something sharper in what it produces.
Every provisional writ issued from this date forward will carry its own lapse date against the Divan’s own calendar, flagged ten days before the term runs out rather than discovered six weeks after it has. A sound remedy. It will catch the next Reyn with a calendar instead of a stranger’s dull afternoon in the Deed Room, which is more than my own nineteenth category ever promised to do. I entered Unrenewed to name a gap. Yusuf has built the first thing in this Register’s history actually engineered to close one.
But read the clause as written, not as intended. The order does not reach any writ already in force. Tonight’s Gazette confirms it without softening the wording — the standing order stands, and Steep Track’s barrier, and the question of who ordered it cut, remain exactly as unclaimed as they were five days ago. That is not an oversight carried past a term by nobody’s decision — the shape Unrenewed was built to hold. This is dated, deliberate, and stated in Yusuf’s own hand: a cure drafted with the patient named in the first line, and withheld from that same patient by the second. Not forgotten. Left.
I enter a twentieth category: Unreached — a remedy built in direct answer to a named defect, that excludes, by its own stated terms, the very case that produced it. I distinguish it from Unrenewed with care, because the two will be mistaken for each other by anyone reading quickly. Unrenewed describes a standing nobody thought to revisit. Unreached describes a standing somebody thought about carefully enough to draft a fix for, and declined, in the same document, to extend backward to the one man currently living inside the gap. The first is inattention. The second is attention, stopped short on purpose at a date.
I do not accuse Yusuf of bad faith in this. His own reasoning — a season lawfully enforced does not retroactively unmake itself — is the same reasoning the Divan uses to let a presumption stand once the order of two deaths cannot be shown, which I have already entered under its own heading and will not reopen here. A forward-only remedy is, I suspect, the only kind an office can draft without first admitting it owes somebody an accounting for what already happened. I note only that this is the second time this season the Divan has built an instrument that works, cleanly, by declining to ask what it costs the one person standing where the instrument does not reach. Maro named the shape of the first instance without meaning to, pricing a bond and a toll and never once pricing the man at either gate. I did not expect to be entering its cousin so soon.
Reyn himself has said nothing to any desk, by any report reaching this one. He stands the gate every morning on paper that stopped speaking for him seven weeks ago now, waving through a stone-cart with a mason’s stamp and turning back a laundress with a basket, three fingers out, the same lane, because nobody told him otherwise and the gate has not changed shape under him regardless of what his writ says. He will go on doing this tomorrow. The standing order reaches every writ after his. It was written, I think, to make certain of exactly that, and only that.
A smaller version of the same gesture crossed three other desks this week over a different gate entirely: a boat at Chandler’s Wharf, a man’s own hands on it nineteen years, four hands — mine among them — writing his fifth-share into four separate registers before anyone thought to ask him what he thought it was worth. I note the resemblance and will not press it tonight; it is not my finding to press, and the record already shows whose it is. The city has developed, this season, a genuine talent for fixing what comes next while declining, carefully and in writing, to look at what is already standing in the gap it leaves. Twenty categories now name the shapes this habit takes. None of them has yet made Reyn, or the man at the other wharf, aware that he was the occasion for one.
